Sham Tsz Kit v Secretary for Justice (FACV 14/2022)

On 5 September 2023, the Court of Final Appeal (“CFA”) released their judgment in Sham Tsz Kit v Secretary for Justice [2023] HKCFA 28, finding that the Government has a positive obligation to establish an alternative framework for the legal recognition of same-sex partnerships and to provide for the appropriate rights and obligations attendant on such recognition.

Daly & Associates welcomes the CFA’s judgment on the Government’s duty to legally recognise same-sex relationships, which takes Hong Kong one step further in the road of equality and human rights, and forms a major milestone in Hong Kong’s history.
